The seeds of control of water pollution law in India may be traced in the common law remedies introduced to establishment of Mayor courts at three presidency towns in India (Chatterjee, 2003). Subsequently, establishment of High Courts in pursuance of Letters Patent Act of 1861 superseded these Mayor courts. The common Law controls of environmental pollution under law were basically classified into:
- Liability for the escape of noxious objects.
- The careless use of noxious articles or pollutants.
- The infringement of property rights in water, to cover various aspects.
